TERMS OF SERVICE: FORTYOUCYBER & TECH SOLUTIONS LLCTERMS OF SERVICE

THIS IS A LEGALLY BINDING AGREEMENT. PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ENGAGING FORTYOUCYBER & TECH SOLUTIONS LLC FOR ANY SERVICES.
This Terms of Service Agreement (“Agreement” or “Terms”) is entered into as of the date of your engagement with FortYouCyber & Tech Solutions LLC (“FortYouCyber,” “we,” “us,” or “our”), a New York Limited Liability Company authorized to do business in New Jersey as a foreign LLC, with its principal place of business operating virtually from New York and New Jersey. This Agreement governs your relationship with FortYouCyber as the “Client” (“you” or “your”).
1. SCOPE OF SERVICES
FortYouCyber provides foundational cybersecurity and technology support services to residential, small business, and freelance clients in New York, New Jersey, and virtually. Services include (but are not limited to):
- Home network security, device setup, computer protection
- VPN configuration, identity monitoring, MFA setup
- Security assessments, website help, basic breach response
- Tech support “odd jobs” and diagnostics
All services will be governed by a written proposal, Service Order, or Statement of Work (“SOW”). No services will begin unless formally agreed upon in writing.
2. CLIENT RESPONSIBILITIES
Client responsibilities include:
a. Providing Timely and Accurate Information
b. Retaining Oversight of Systems and Data
c. Backing Up All Data Independently
d. Following Basic Security Hygiene
e. Complying with Federal, NY, and NJ Laws and Regulations
3. PAYMENT TERMS
- Fees are due upon service completion unless agreed otherwise.
- Accepted Payments include Zelle, Venmo, PayPal, cash, or check.
- Late Payments: After 5 days, a 5% monthly fee applies.
- Estimates Are Not Guarantees unless fixed in writing.
4. NO GUARANTEES OR WARRANTIES
All services are delivered as-is and as-available, without warranty.
No service can guarantee to eliminate all cyber threats or system failures.
5. LIMITATION OF LIABILITY
FortYouCyber’s total liability is limited to $100 or the amount paid by Client in the prior 6 months, whichever is less.
We are not liable for:
- Data loss, business interruption, or cyberattacks
- Client missteps or third-party product failures
- Consequences of disregarding our guidance
Note: FortYouCyber is operated by a sole individual under an LLC; liability is limited strictly to the LLC entity.
6. INDEMNIFICATION
You agree to indemnify and hold harmless FortYouCyber & Tech Solutions LLC and its owner/operator against any third-party claims, damages, or legal costs arising out of your actions, negligence, or noncompliance.
7. SERVICE-SPECIFIC DISCLAIMERS
- Crypto Security: FortYouCyber is not a financial or investment advisor.
- Online Reputation Help: We cannot guarantee content removal.
8. CONFIDENTIALITY
We keep your information confidential, using reasonable safeguards. This excludes publicly available, independently obtained, or legally compelled information.
9. INTELLECTUAL PROPERTY
FortYouCyber retains ownership of all internal tools, methods, and processes. Clients are granted limited-use licenses only for agreed deliverables.
10. DEFAULT AND TERMINATION
- Client Default: Failure to pay or cooperate within 5–10 days after written notice.
- Our Remedies: Immediate suspension or legal enforcement including court costs and administrative fees.
- Court Time Compensation: $750/day + $250 administrative fee per infraction if legal appearances are required.
11. GOVERNING LAW
This Agreement is governed by the laws of New York State, but we acknowledge and operate in New Jersey under authority of a foreign LLC registration. Clients in either state agree to this dual-state framework.
12. DISPUTE RESOLUTION
All disputes shall go through:
- Good Faith Negotiation (30 days)
- Non-binding Mediation (shared cost)
- Legal Action, only after steps 1 and 2 fail
13. MODIFICATIONS
We may amend these Terms at any time. Updates will be posted at https://fortyoucyber.com or sent via email. Continued service use implies acceptance.
14. SEVERABILITY
If any part of these Terms is found invalid, the remainder will still apply.
15. ENTIRE AGREEMENT
These Terms + any executed Service Orders represent the full agreement between you and FortYouCyber.
